According to the lawsuit filed, Oakhurst Industries, Inc. allegedly failed to reimburse employees for required business expenses. California Labor Code § 2802 expressly states that “an employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties…” During employment, Plaintiff and other Aggrieved Employees were allegedly required to use their personal cellular phones in order to complete their job duties.

PAGA is a mechanism by which the State of California itself can enforce state labor laws through the employee suing under the PAGA who do so as the proxy or agent of the state’s labor law enforcement agencies.
